The leading domestic pharmaceuticals company, Cipla has received an allowance from the Delhi High Court on Wednesday, as the court has dismissed an injunction plea filed by the Swiss multinational company Roche Scientific Company (India) against the plan of Cipla. The Roche was actually trying to prevent Cipla from marketing a generic version of the lung cancer drug, for which Roche is having the patent.
The sources from Cipla have informed that the company will now enjoy the right to sell the drug named erlotinib, that is being marketed by Roche under the brand Tarceva. The Cipla is now authorised to sell the drug at one-third price of the patented product in the Indian market. The sources added that the HC has also asked Cipla to maintain the record of erlotinib sales for compensating for possible damages in the eventuality of a favourable court ruling for Roche. The sources further added that the HC has admitted the counter-claim filed by Cipla and thus asked Roche for responding to the counter-claim within a period of four weeks. The next hearing for the case will be held on 6th August.
